ANEEL defines new rules for consumer access to the Basic Transmission Network

The National Electric Energy Agency (ANEEL) approved, in its last Ordinary Public Meeting, the guidelines that regulate the access of consumer units to the Basic Grid of the Transmission System. The measure consolidates the result of Public Consultation No. 23/2024, held to receive contributions and subsidies from various agents in the electricity sector. The new rule, formalized in revision 4 of Module 5 of the Transmission Rules, will come into effect on January 1, 2026, but with immediate effects for the financial guarantees for requesting and contracting access.


Financial guarantees and regulatory improvements


According to the approved draft Normative Resolution, consumers interested in accessing the Basic Grid must present the Financial Guarantee for Requesting Access (GPA) immediately, in addition to the Financial Guarantee for signing the Transmission System Use Agreement (GPC). These provisions aim to ensure the economic viability of requests and strengthen the legal security of operations in the National Interconnected System (SIN). At the same time, the Resolution establishes that the National Electric System Operator (ONS) will have 90 days to propose changes to the Grid Procedures, aligning them with the new regulatory improvements. Another highlight is the Regulatory Outcome Assessment (ARR), which must be carried out within two years after the new rules come into effect, to verify their practical effects and any adjustments.


The contributions received during the consultation were significant: 152 suggestions were submitted by 34 institutions, including generation and transmission agents, large consumers, consumer councils and consultancies. Of the total, 36% were fully or partially accepted, 48% were not accepted and 16% were considered outside the scope. The result reflects ANEEL's efforts to reconcile diverse interests and promote the modernization of access to the Brazilian electrical system, at a time when the reliability and efficiency of the energy infrastructure are increasingly strategic for the country's development.
