The Federal District expands its legal framework and begins to incentivize low-carbon hydrogen

The Federal District has taken a significant step in the energy transition agenda by expanding its public policy focused on hydrogen. With the enactment of Law No. 7,839/2025, the Federal District updated and expanded the District Hydrogen Policy, originally focused on low-carbon hydrogen, to encompass all low-carbon hydrogen (H2BC) routes. This measure aligns district legislation with the recently established federal framework and positions the capital as one of the most advanced federative units in the country in promoting energy alternatives with lower environmental impact.
Incentives, federal alignment, and economic impact
The new legislation broadens the scope of the district policy by recognizing different forms of hydrogen with low CO₂ emissions, opening up opportunities for applications in public transportation, industry, and the production of strategic inputs such as agricultural fertilizers. In addition to harmonizing the local framework with federal legislation, the District Policy for Low-Carbon Hydrogen establishes guidelines to promote production in the Federal District, including tax and credit incentives—subject to budgetary availability—for the acquisition of equipment and the development of H2BC-based systems.
